2008 USA Road Bear RV Rentals
Terms and Conditions

Depots:
We offer pick up and drops off in the following places:
California: Los Angeles and San Francisco
Nevada: Las Vegas
Colorado: Denver
New York: Middletown, New Jersey

One Way Trips:
Upon availability, one-way trips are possible between all stations for a one-way fee as specified on the rate sheet. One-way fees will not be refunded in case of cancellation.

General restrictions:
Minimum Age: The minimum age for the rental of a RV is 25 (younger upon request only).
Pets: Pets are not allowed.
Smoking: Smoking is not allowed in any RV. A fee of US$250.00 for cleaning/deodorizing applies.

Travel Restrictions:
Mexico:  Traveling into Mexico is not permitted
Death Valley: Traveling into Death Valley is not permitted between June 15th and September 15th.
Alaska: Traveling within Alaska, Yukon and/or NWT is permitted. Road Bear RV must be advised at the time of reservation.
Winterization: Vehicles are winterized between November 1st. and March 31st., depending on the pick-up location. It is not possible to use the water-/waste systems during this time or when outside temperatures are below freezing!
Other: Private-, gravel-, dirt- or logging roads and other non-public roads, beaches, etc. are prohibited.
Road Bear RV will hold the customer fully responsible for accidents or mechanical breakdowns occurring in a travel restricted area!

Booking Changes, Cancellations, and Refunds:
Bookings may be changed once free of charge. US$ 50.00 per change thereafter.
Cancellations must to be made in writing. The day of receipt of the cancellation is the date the cancellation fee is calculated as follows:
Cancellation fees: Every cancellation needs to be made in writing. The day of receipt of the cancellation is the date the cancellation fee is calculated as follows:
- 60 calendar days or more prior to rental date US$ 100.00
- 59 to 30 calendar days prior to rental date 20% of the nightly rental charge plus one-way fee if applicable
- 29 to 15 calendar days prior to rental date 50% of the nightly rental charge plus one-way fee if applicable
- 14 to 0 calendar days prior to rental date 100% of the nightly rental charge plus one-way fee if applicable
No Refunds for Unused Portion
(Please Note) One-way fees will not be refunded in case of cancellation
No refund will be given in the following cases:
Vehicle is returned prior to the contracted dropoff date
Prepaid miles are unused
Client arrives late to pick up the RV or does not show up at all

Shuttle Service to/from Airports: No transfers from/to Downtown areas. Transfers are only available to/from certain airports and airport hotels. No transfers after 1:00 PM. Transfers are between 11:00 AM and 1:00 PM only.
Clients cannot pick up the RV the day they arrive from overseas. We recommend staying the first night at an airport hotel or motel. Clients are not entitled to a complimentary transfer in case of late RV return.

Hours of Operation: Monday through Friday from 8.00 am to 5.00 pm, Saturday from 8.00 am to 1.00 pm. All stations are closed on Sundays and on all statutory holidays.

Vehicle Pick-Up:
Pick-Up Time is between 12:00 noon and 4:30 PM
CUSTOMER ORIENTATION: Staff speaks German & English at all locations - Dutch, French & Italian at some locations. After completing the paperwork the clients get a very thorough personal walk-thru of the recreational vehicle. In addition every vehicle is equipped with an operation manual in English/German.

Gasoline, Propane and Oil: The cost of gasoline, oil and propane is not included and ROAD BEAR RV
does not assume responsibility for estimates of consumption. All vehicles are delivered with full tanks and the customer is expected to return the vehicle with full tanks or will be charged accordingly.

Cleaning Fee: The clients are responsible to return the vehicle with the interior cleaned and holding tanks dumped. The vehicle outside does not require cleaning by the customer. Cleaning- and/or dumping charges with a US$ 50.00 minimum each will apply otherwise.

Storage : We provide free storage of luggage at the rental station at client's own risk.

$750 Damage Deposit: Road Bear RV requires a security deposit of US$750.00 at the time of pickup.
Additional deposit may be required for special events e.g. 'Burning Man'.
Security Deposit will be authorized (not charged) on credit card at the time of pickup.
Card holder must be present at the time of RV pick-up.
If the RV is returned damaged, the credit card will be charged to cover repair costs, up to a maximum of $750.00.

Driver's License: A valid national driver's license is required for each driver at the time of pick-up. An international driver's license is recommended but not required for foreign customers. The minimum age for the rental of a RV is 25 (younger upon request only).

Vehicle Substitution:If for any reason the booked RV should not be available, Road Bear RV reserves the right to substitute a higher-rated RV at no additional cost. Should a lower-rated RV be substituted, the liability is limited to the refund of the gross rate difference of the two vehicles.

Your Responsibilities while Operating the RV
Gasoline and Oil: The cost of propane, gasoline and oil are not included and Road Bear RV does not assume responsibility for estimates of consumption. All vehicles are delivered with full tanks and the customer is expected to return the RV with full tanks or will be charged accordingly.

Maintenance: The customer is responsible for checking engine oil and coolant levels at each refueling as well as reporting mechanical failures immediately. Coolant refills and authorized repairs will be reimbursed upon return of the RV and presentation of all receipts (see Mechanical Breakdown). It is the driver's responsibility to operate the RV in a safe manner and to exercise all caution possible.

Mechanical Breakdown/Repairs: For repairs exceeding US$ 50.00 the customer must call the ROAD BEAR RV 24-hour toll free telephone assistance to obtain proper authorization. Non-authorized repairs exceeding US$ 50.00 will not be reimbursed. Receipts must be presented to Road Bear RV for reimbursement. Customer will be held responsible for mechanical damage due to negligence in operation and/or maintenance. Customers are required to cooperate fully with Road Bear RV to remedy any problem.

If Renter's motor home vacation is interrupted by an automotive mechanical breakdown for more than 12 working hours after reporting such to Road Bear RV, the Renter will be reimbursed for the greater of: (i) the gross daily rate or: (ii) expenses for hotel rooms up to US$ 25.00 per person per night and car rental up to US$50.00 per day per motor home to a maximum of US$1,500.00 per tour. Receipts for all incurred expenses must be presented for refund. Radio, TV / VCR / DVD / CD / Cassette Tape, generator, air conditioning, fridge, cruise control, awning, slide-out malfunction, etc. are not considered to be mechanical breakdowns.

Defects on Radio/CD/Tape/TV/VCR/DVD, Air Conditioning, Refrigerator, Generator, Awning, Slide-out and Cruise Control are not considered a technical defect on the RV and there is no refund.

In the Event of an Accident: The customer must obtain a local police report as provided by the attending police officer investigating the accident. An accident report form is supplied to the customer and is located in the RV along with the registration and insurance papers.
Road Bear RV must be notified as soon as possible. A full-written report along with the other party's name, address, phone number, insurance information and driver's license number on the supplied accident report form will be required upon return of the RV.
All documents relating to the accident must include a police report number or identifying number.
Insurance coverage may be void if the above instructions are not followed.

Parking/Traffic Violations
It is the clients responsibility to report and pay for all parking/traffic violations at check-in. Failing to report these violations at drop off will cause a charge of an administrative fee of up to $100.00 plus the fine (including all late charges) to the clients credit card.

Vehicle Return:
Dropoff Time: Between 8:00 AM and 11:00 AM
No complimentary transfers to the Airports after 11:00 AM
Charges for late RV return or unauthorized extension of the rental period: US $30.00 per hour or US $300.00 per day (plus applicable rental charge). The regular rental rate may apply only with proper authorization through Road Bear RV. You are are advised to return the RV with the interior cleaned and holding tanks dumped to avoid any cleaning/dumping charges.

Included in the daily rate are:
Public liability insurance to cover accidents in the event that the renter is at fault. The policy protects the company for US$ 1,000,000 and the renter to statutory limits.

A US$ 750.00 deductible for accidental damage: "accidental damage" includes but is not limited to: (i) motor vehicle accident; (ii) vehicle theft; (iii) vandalism; (iv) fire; (v) windshield & glass damage

If renter's motor home vacation is interrupted by an automotive mechanical breakdown for more than 12 working hours after reporting such to ROAD BEAR RV, the renter will be reimbursed for the greater of: i) the gross nightly rate or: ii) expenses for hotel rooms up to US$ 25.00 per person per night and car rental up to US$ 50.00 per day per motor home to a maximum of US$ 1500.00 per tour. Receipts for all incurred expenses must be presented for refund. Radio, TV/VCR/DVD, generator, air condition, fridge, cruise control, awning, slide-out & automatic entry step malfunction, etc. are not considered to be mechanical breakdowns.

Negligent Damage
US$ 3000.00 responsibility for negligent damage: “negligent damage" refers to accidents caused as a result of driver's negligence and includes but is not limited to: (i) accidents occurring off road; (ii) accidents occurring while backing up; (iii) damage above windshield caused by striking overhead objects, undercarriage damage (including tires and wheels); all damages caused by misuse of slide-out and awnings; (iv) damage caused by freezing of the vehicles systems (when temperatures are below freezing, it is not permitted to fill the water tanks)

The following losses are not covered if damage is caused by:
Deliberate or willful damage caused by renter or guests
Personal contents are never covered
Failure to maintain all fluid levels
Driving under the influence of alcohol or drugs
Traveling in restricted areas
Carrying more passengers than having seat belts available
Failure to use specified fuel
Operation by anyone under 21 years of age

Additional liability coverage can be purchased as described below:
Supplemental Liability Insurance (Optional): Supplemental Liability Insurance (SLI) may be purchased for an additional fee. SLI provides the customer with an increased limit of liability protection for up to US$1,000,000 toward a 3rd party.
